- To comply with Education Law §2-d, the state’s data privacy law, school districts and BOCES were to have adopted and posted on their website the Data Security and Privacy policy by Oct. 1. This policy must be posted along with its Bill of Rights for Data Privacy and Security and Supplemental Information about each contract for services between the district and a third-party contractor where the contractor receives personally identifiable information (PII) protected by Education Law §2-d. Districts that have not taken these steps yet should do so. In addition, districts must start to plan annual training on the district’s data privacy and security program.
